Woman Fired for Filing Workers' Compensation Benefits

Chicago, illinois, February 5, 2015 (Newswire.com) - On January 14th, Penny Lucas filed a lawsuit in St. Clair County Circuit Court claiming(https://axczcx.top) that she was fired from her job at the Atrium Healthcare and Rehabilitation Center of Cahokia after she filed for workers' compensation benefits. Lucas injured herself in a fall that occurred at work on December 27th, 2012. Following her accident, she filed for worker's compensation to cover treatment of her injuries.

Two weeks after the incident, she was required to submit to a post-accident drug test. The test came back negative. However, on January 15, 2013, her employer insisted she submit to a second drug test which they allege came back positive. At that time, Lucas insisted the hospital retest her urine which they refused to do.

Using the alleged positive drug test, the Atrium Healthcare and Rehabilitation Center of Cahokia terminated Lucas' employment. Lucas claims that the drug test was inaccurate(https://aaamjn.top) and that the facility fabricated the test results in order to give them grounds to terminate her employment as retaliation for filing the workers' compensation claim.

As a workers' compensation attorney in Illinois, Sheldon Minkow has seen a number of cases where employees were fired for filing to receive workers' compensation benefits. Lucas is suing for punitive and exemplary damages, interest, attorney's fees, and subsequent relief in excess of $75,000. In order for her suit to be successful, Lucas must prove that her employer acted to deliberately violate the Illinois Workers' Compensation Act which prohibits retaliatory action when employees file for workers' compensation benefits.
